Rental Terms
1. Rental Price
The rental price includes electricity and all services other than long distance phone calls. Spa-Pool heat can be ordered for a small additional amount. State and Government tax will be charged separately (13% from of July 1, 2004). The home will be cleaned before your arrival and upon your departure. Cleaning is included in the rental rate for reservations of at least one week (7 nights). For reservations of less than 7 nights the actual cleaning charges will be charged to the guest.
2. Reservation Deposit and Rental Payment
Initial reservations can be made by e-mail or telephone. Reservation will be confirmed after payment of a deposit of US$250.00 for reservation up to 7 nights and US$500 for reservation of 8 nights and more. Deposits are non-refundable, except as described in chapter 4 "Cancellation Policy"
Full payment for rental must be made no later than 45 days prior to arrival date. If full payment is not received, your reservation will be cancelled and your deposit will be forfeited. The home will be made available for new reservations. Obligation for payment of full amount will be applicable. See chapter 4 for cancellation policy.

All cancellations must be received in writing and are subject to the following penalties:
Cancellation 6 weeks or more before arrival date is subject to a cancellation charge equal to the deposit paid. If the home will be rented out again for the canceled period, the paid deposit will be returned, less US$50 administration charges.
Non-payment of the full amount 45 days prior to arrival date will lead to cancellation of the reservation and the deposit will be forfeited.
Cancellations less than 6 weeks before arrival date, is subject to a penalty of 100% of the rental amount. If the home will be rented out again for the canceled period, the paid amounts will be returned, less US$50 administration charges.
The maximum number of overnight persons permitted in the home is 12. Any number of persons in excess of 12 must vacate the property, and it is an express term of this agreement, that you accept.
While the property will be cleaned on departure, you are expected to carry out reasonable care, and treat the property carefully and with respect. It is expected that you will leave the property in a reasonably clean and orderly condition. Excessive dirt or work for the cleaning team, will result in a charge to be deducted from the security deposit.
7. Safety and Liability
We the homeowners or our agents do not accept any liability or responsibility for any injury caused as a result of the use of our properties or pools.
It is the responsibility of an adult member of the party, to ensure that children are always properly supervised when in the pool area. Children ARE NOT permitted in the pool or pool area unattended. Posted pool rules must be adhered to while in the pool area.
Use of a BBQ is permitted ONLY outdoors. It is the responsibility of the guests to use the BBQ responsibility and safely so as not to cause harm to people or property. The BBQ grill is free to use. Guests are responsible for cleaning the grill if they use it.
If the management company find that the grill is not cleaned the additional cleaning expenses will be charged.
8. Insurance's, etc.
We the homeowners or our agents do not accept responsibility for any loss of personal items while staying in the property or after departure. It is your responsibility to take out appropriate insurance to cover all aspects of your trip, and to ensure that passports, visas and other documents are in order. Keeping valuables in the house is at your own risk, we accept no responsibility for lost or stolen property. Although most hospitals must treat emergencies, thereafter medical care can be extremely expensive, and we urge you to ensure that all members of your party have appropriate insurance.
9. Booking
These conditions and the reservation constitute a contract between the owner of the property and the person who made the reservation. A contract shall only exist once the reservation and the deposit have been received by us, and a confirmation is issued.
10. Complaint or Dissatisfaction
In the unlikely event of a problem arising, it should be discussed with our local Property Manager first. We will attempt to resolve any dispute immediately. We will not be held liable for the actions of any third party or public utility, or their inability to provide services, or any other service provider, over whom we do not exercise direct control. We will also not be held liable for any problems arising from or brought about, or become necessary, due to war or threat of war, riot, civil commotion, terrorist act, industrial dispute, natural disaster, fire, flood or adverse weather conditions or nuclear incident.
11. Access
Once the full balance and security deposit have been paid, you will be issued detailed directions to the Terra Verde Resort. The local management company is located in the central clubhouse and is your personal local contact that will assist with giving you keys to the property along with a Welcome Package of Helpful Information.
12. Pool Heating
The use of pool heating cannot guarantee the actual temperature of the water in the pool. This is dependant on many factors, including the ambient temperature, general weather conditions, and number of people using pool. In severe conditions, you may not be able to use the pool heating at all. We cannot, therefore, guarantee that pool heating will actually heat the pool water to a degree, comfortable enough to swim in. You must also be aware that, outdoor pool heating will not take the temperature to that of an indoor tub or spa.
